In Sulphur Springs, the fight over one of the largest AI data centers proposed in the country is not between residents and a developer but between the city and the company that gave it the land. Luminant Mining, a subsidiary of Vistra Corp., conveyed about 5,000 acres of former mining land to the city in 2019 as part of a bankruptcy agreement, and the city partnered with developer MSB Global to build 30 AI data centers there. On September 30, 2025, Vistra sent the city a cease-and-desist letter, arguing the deed bars power generation on the property and MSB's plans included it; the city sued, saying the covenant was added only on the day the deed was signed.
The court has gone Vistra's way so far. A visiting judge dismissed part of the city's fraud claims in January, denied its motion for summary judgment in February, and issued a temporary injunction barring construction of any power generation or storage on the site while the suit proceeds; a later ruling found the covenant valid and enforceable, with trial not expected until November 2027. By July the mayor said MSB Global would no longer lead the development, with no replacement yet named.

Residents are paying for the fight: in May the City Council added more than $1.6 million to its budget for legal costs, on top of about $230,000 already spent, though Mayor Tyler Law said taxes would not rise. "We did not ask for this project to go forward... all of the legal fees... are something we never even got a vote on," resident Tina Stout told the council. A second lawsuit accuses city leaders of failing to disclose the project's details to the public.
A second company, CyrusOne, says on its own website that it is evaluating a separate, unrelated data center campus nearby in Hopkins County. What the disputed campus would pay the city, and who would now build it, remain unknown.
