New Mexico's biggest data center, Project Jupiter, is under construction at Santa Teresa in Doña Ana County for Oracle. On September 17 the state Supreme Court turned down two challenges from environmental groups and lifted the temporary halt it had ordered on August 23, so the state's review of the project's air pollution permit and its pumping from a new well can go ahead.

The groups questioned whether the air permit review cut corners and argued that the state engineer let the new well be drilled without a public hearing; the Center for Biological Diversity says the well has pumped more than 100 million gallons since April. The state engineer's lawyer, Nat Chakeres, told lawmakers that "the total amount of water that Project Jupiter has stated that they need has changed over time." Researcher Margaret Cook told them data centers now use about half of 1% of the state's water but would use 23.6 billion gallons a year if every planned one were built.

Two counties have paused new data centers. Socorro County passed a one-year moratorium in June after protests over a proposed project there, and Santa Fe County, where none has been proposed, unanimously approved an 18-month moratorium while staff write rules on water, power and land use. In Bernalillo County, commissioners ruled in February that any data center seeking tax incentives must pay its own power and water costs, fully offset its water use and pay workers at least 120% of the area median salary.

Meta runs a large campus at Los Lunas in Valencia County, and Project Zenith is planned near Roswell in Chaves County. State Democrats plan to introduce a statewide data center moratorium in the 2027 legislative session.
