Guadalupe County has two large data center campuses under way in its northern end, and both are now the subject of a lawsuit. CloudBurst Texas, an AI campus planned for Francis Harris Lane near the Hays County line, won a tax abatement from the Commissioners Court on a 3-2 vote on April 21, 2026, after the court had rejected an earlier version 3-2 in February. As presented, the campus would have 10 to 12 buildings on about 700 acres and cost an estimated $14.5 billion.

Commissioner Stephen Germann, who voted no both times, said in February, "We are out of water," pointing to farmers' wells going dry; CloudBurst co-founder Cynthia Thompson said the campus would generate its own power with turbines and use 24,000 gallons of water a day. The abatement starts at 90 percent and tapers to full taxes after year 11, and Navarro ISD will tax the full value. Commissioner Jacqueline Ott, an attorney, said the deal gave her "grave concern in both terms of risk and liability."

The county's second project, Palomino Alpha, sits near Zorn beside a major regional power substation. Its reinvestment zone grew in February on a 3-1 vote, with County Judge Kyle Kutscher abstaining because his family owns land in the project area. The Crystal Clear Special Utility District is weighing a request to let the site use up to half a million gallons of water a day; at an August 27 meeting, board member Joseph Benavides said, "It really sounds like they're just telling us what we want to hear."

In July 2026, attorney Bobby Levinski of the Save Our Springs Alliance sued the county and each commissioner on behalf of the Data Center Action Coalition and three residents, alleging Open Meetings Act violations and a conflict of interest over Kutscher's family land sale to Palomino Alpha. The suit asks the court to bar the county from relying on either abatement agreement; the county attorney's office says it does not comment on pending litigation.
