A 1,000-megawatt data center that has never been formally proposed to the town has led East Fishkill to close the door for three years. In May 2026 residents learned that New Jersey-based Treetop Companies had asked the New York grid operator to study connecting an AI and cloud computing center on wooded land off Lime Kiln Road, big enough to use as much power as roughly 800,000 homes, with a first phase planned for 2028. On June 25, after a nearly two-hour hearing, the Town Board voted unanimously for a moratorium on large-scale data centers until July 1, 2029.

The town's code does not already permit data centers in industrial zones, and Treetop's related warehouse application had been frozen since September 2024 by a separate town moratorium. The new rule bars permits for any data center "until the completion of federal and state studies" of their power and water use, noise and heat, though it exempts uses under 20 megawatts. "A moratorium gives us time," Supervisor Nicholas D'Alessandro said, noting Treetop had no formal application. Residents' fears centered on water in a town "basically on well water" over aquifers, as Fran Caracappa put it, along with electricity rates, noise and property values.

Treetop's lawyers sent the town a letter objecting to the moratorium, town attorney Thomas Wood said, and the company did not respond to reporters. Some residents asked for a permanent ban, but Wood said state law requires moratoriums to be limited in time. The Times Union counted six other data center proposals in the Hudson Valley, including one at iPark 87, also in East Fishkill.

The state fight runs through Dutchess too. On June 4 the Legislature passed a one-year moratorium on state environmental permits for data centers; in July Governor Kathy Hochul instead issued an executive order pausing state permits for projects of 50 megawatts or more, while the broader bill, reaching centers as small as 20 megawatts, still awaited her decision as of late August. What happens next: her decision on that bill, the task force's recommendations, and whether Treetop challenges the town's pause.
